These General Terms and Conditions (GTC) regulate legal relationships for sales of food and beverages via the elanetfood.ch web platform.
1. CONTRACTUAL TERMS
These terms and conditions apply to all digital orders on elanetfood.ch. These are recognized with every order. Orders and deliveries are made at the specified conditions.
The general terms and conditions including all possible attachments can be changed or supplemented at any time. The current status of these terms and conditions is published on elanetfood.ch. Orders received before a change are still processed according to the old general terms and conditions.
1.1 OFFER, ORDER AND CONCLUSION OF CONTRACT
The offers, which can be seen on elanetfood.ch, represent a non-binding offer to customers to order food and beverages.
By sending an order to elanetfood.ch and at the same time accepting these terms and conditions, customers make a legally binding offer to conclude a contract.
The order confirmation, which is then sent automatically by email, documents that the customer's order has been received by elanetfood.ch. The contractual relationship comes about through the order and advance payments by the customer as well as the electronic declaration of acceptance of this order.
In view of the perishability of the offer, in the event of a cancellation by the customer, the price already paid will be retained in full by the elanetfood.ch.
The elanetfood.ch can cancel orders in whole or in part without giving reasons. The price already paid will be fully or partially reimbursed in the form of elanetfood.ch vouchers.
The product prices listed before the order is sent are binding. All prices are in CHF. VAT is included in all prices. There is no minimum order value.
With the conclusion of the contract, customers transfer one-off or recurring orders according to the offer on elanetfood.ch.
The elanetfood.ch undertakes to process the order carefully and to provide the products on time and to the satisfaction of the customers. When choosing food and beverages (“Food”), great value is placed on perfect quality.
The elanetfood.ch makes every effort to deliver quality products to its customers. Our customers' satisfaction is our top priority.

The elanetfood.ch is careful to provide correct product information. All products can be seen on the elanetfood.ch. The menus are packed on the morning of the delivery day and given the appropriate date. The products are handed over to the customers at the pick-up stations. They are chilled products; warming up the menus before eating is recommended.

The elanetfood.ch is entitled to reject all (future) orders from customers if there are appropriate reasons.
3. PAYMENT TERMS
3.1 PAYMENT METHODS
Orders on elanetfood.ch are paid in advance by credit card or PayPal.
3.2 REFUNDS, CREDITS, VOUCHERS
For goods classified as defective, customers receive appropriate compensation in the form of elanetfood.ch.
The elanetfood.ch reserves the right to request proof of the defect before the refund is made.
All claims for damages are excluded. Unless they are based on intent or gross negligence.
The customers undertake to check the collected products for completeness and condition immediately upon receipt. Any complaints regarding quality and completeness must be reported to the elanetfood.ch immediately, but at the latest within 24 hours after delivery. Otherwise, the delivery is considered accepted.
In the event of complaints, the purchase date must be proven with confirmation. The guarantee does not extend to normal wear and tear. The warranty expires if customers change the delivered goods.
5. JURISDICTION AND APPLICABLE LAW
These terms and conditions are subject to Swiss law. Baden is the exclusive place of jurisdiction.
